CONNEB, Chief Justice.

On appeal from the Justice Court to the County Court appellee recovered a judgment against appellant in the sum of one hundred and seventy-five dollars as the value of one mare and colt killed by a passing train in the town of Hamlin on about the 6th of November, 1908. The evidence shows that the animals were injured at a distance of from two hundred and fifty to three hundred and fifty yards from the east end of appellant’s depot, .within'the appellant’s switch limits.
