The State moved to dismiss the motion for new trial on the ground that no brief of evidence was filed as a part of the motion for new trial on March 12, 1964, and no valid order extending the time for filing such brief of evidence was ever entered. The trial judge overruled the motion to dismiss the motion for new trial. In this court counsel for the State argue that, since the Governor’s order appointing the judge emeritus to serve was for the week of March 2, 1964, the judge was without authority to continue the motion as was done by the order filed on March 12, 1964.
