This was an indictment for arson. The plaintiff in error was convicted, and moved the court for a new trial. The main assignment of error in this case is that the court failed or refused to charge the jury upon the question of the issue raised by the plaintiff in error of alibi. The evidence in the ease is mainly circumstantial, although there appear some admissions or confessions made by the plaintiff in error.
