OPINION
{¶ 1} On March 12, 2007 Melikia Sylvester was indicted on one count of endangering children resulting in serious harm pursuant to R.C. 2919.22(A), a felony of the third degree, and reckless endangerment of children pursuant to R.C. 2919.22(A), a misdemeanor of the first degree. These charges stemmed from an incident which took place on December 12, 2006 when Ms. Sylvester was babysitting for the three year old son of a friend.
