In an action to recover damages for medical malpractice and lack of informed consent, the defendant appeals from an order of the Supreme Court, Rockland County (Loehr, J.), entered July 25, 2013,which denied his motion for summary judgment dismissing the complaint.

Ordered that the order is modified, on the law, (1) by deleting the provision thereof denying that branch of the defendant’s motion which was for summary judgment dismissing, as time-barred, so much of the complaint as was based on alleged acts of medical malpractice and lack of informed consent occurring before June 29, 2007, and…
