In an action to recover damages for medical malpractice and lack of informed consent, the plaintiff appeals from an order of the Supreme Court, Suffolk County (Jones, J.), dated March 3, 2006, which granted the defendant’s motion for summary judgment dismissing the complaint.
Ordered that the order is modified, on the law, by deleting the provision thereof granting that branch of the defendant’s motion which was to dismiss the plaintiffs cause of action alleging medical malpractice and substituting therefor a provision denying that branch of the motion; as so modified, the order is affirmed,…
