The plaintiff brought this action to recover damages against the defendant for an alleged trespass in unlawfully dumping'materials, which were dredged from the channel of the Hudson river, into the waters of the river adjacent to his lands. He claims that, thereby, his right of access to and from the navigable part of the river and his rights to take ice and of fishing have been impaired, or destroyed.
