This is an action on a promissory note executed by the defendant Marie L. Taylor during cov-erture. Judgment was rendered against her and the community composed of her and defendant Frank W. Taylor. The latter alone appeals from the judgment against the community.
Respondent interposed a motion to dismiss the appeal, but the motion cannot be granted, because the court, with eight members sitting, is evenly divided on the question raised. We shall therefore pass to the merits of the controversy.
