The defendant was indicted for obtaining money from Chris Lovende by means of the confidence game. He was tried before a jury, found guilty and sentenced to the penitentiary for a minimum of three and maximum of eight years. The defendant’s sole contention here is that he was not proved guilty beyond a reasonable doubt.
The People filed a motion in this court to affirm the judgment of conviction on the ground that the bill of exceptions was not certified within the time provided for by Rule 65 of this court. We denied this motion since we preferred to deal with this contention in an opinion.…
