MEMORANDUM

WISEMAN, Senior District Judge.

Before the Court is defendant’s motion to dismiss complaint for (1) lack of standing, (2) failure to state a claim upon which relief may be granted, and (3) failure to exhaust administrative remedies. Also before the Court are plaintiffs motion to amend complaint and supplemental brief in opposition to the motion to dismiss, and defendant’s responsive motion to strike pleadings.
