The bank sued one Gates and wife to recover a judgment upon a promissory note. On the 6th day of August, 1915, the bank recovered a judgment upon said note. At the time of the institution of the action garnishment i roeeedings were issued against one Brown, who filed an answer, denying that he had in his possession any property belonging to the defendant in said action. The bank joined issue upon the answer of the garnishee, Brown, and on the 12th day of August, 1915, the issue between the plaintiff and the garnishee was tried, and judgment rendered in favor of the…
