The plaintiff in error was indicted July 12th, 1909, at a Special Term of the Circuit Court in Dade County for the murder by cutting of David Scott on April 12, 1909. This writ of error was taken to a conviction of murder in the first degree and a life sentence. The bill of exceptions shows that on July 14th the defendant was arraigned on the indictment, pleaded not guilty and announced that he was ready for trial; that a trial was had and the jury failing to agree a mistrial was ordered and the case set for another trial July 22, 1909.
