*1229Appeal from a judgment of the Supreme Court, Monroe County (David D. Egan, J.), rendered December 30, 2003. The judgment convicted defendant, upon a jury verdict, of attempted robbery in the first degree and assault in the first degree (two counts).

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
