The appellee and plaintiff below, Mack "Walls, was a man about forty years of age at the time he testified and for more than twenty years had worked for the Cincinnati, New Orleans and Texas Pacific Railway Company as a section hand, but on the 12th day of June, 1919, at the time he sustained the injuries for which he sues, the railroad was operated by Walker D.
