COVINGTON, Judge.

This action commenced as a petition for judicial review of the administrative approval for capital expenditures under Section 1122 of the Social Security Act, 42 U.S.C. Section 1320a-l, given to Lifemark Corporation (Lifemark) by the Louisiana Department of Health and Human Resources (DHHR). National Medical Enterprises, Inc. (NME) sued Roger Guissinger, Lane Carson and Murray Forman in their official capacities with DHHR, and DHHR.
