1Opinion of the CourtDowney, J.
Indictment for murder in the first degree against the appellant and another. The indictment is in two counts, and each for the murder of Thomas S. Christopher. The cause was tried by a jury, the defendant was found guilty of manslaughter, and his punishment fixed at four years’ imprisonment in the state prison. A motion for a new trial was Overruled, and judgment rendered on the verdict.
The only error assigned, presenting any question, is the refusal to grant a new trial. The motion for a new trial contains two grounds on which it is claimed the new trial should have been granted.
