Appeal from Civil District Court, Parish of Orleans; Porter Parker, Judge. Action by Frederick Badie, with supplementary action after his death by his widow, Ethel Etta Badie, against the Columbia Brewing Company. Demand rejected, and the widow, in her own behalf and in behalf of her infant child, appeals.

This is an action for $25,000 damages for personal injuries suffered by the plaintiff by falling from a balcony of a house belonging to the defendant. The railing was *855in need of repairs, and broke when the plaintiff leaned against it. The suit is therefore founded upon the provisions of the Civil Code that the owner of a building must keep it in a condition of safety to others and is responsible in damages for any injury that results from his failure to make necessary repairs. R. C. C. 670 and 2322.
