McCALEB, Judge.

On July 30, 1936, at about 9:30 a. m., the plaintiff, Miss Laura Gallaher, received personal injuries when she was struck by an automobile owned and operated by a young negro minor named Nathaniel W. Ricketts.

On May 11, 1937, the present suit was instituted by the plaintiff for recovery of $5000 damages against Mrs. Nathaniel W. Ricketts, the mother of the minor, and the Times-Picayune Publishing Company, who was alleged to be Ricketts’ employer. On May 14, 1937, the sheriff made a return to the citation issued to Mrs. Ricketts in which he stated that he had been unable to…
