YOUNG, Justice.
This is a second appeal; on first appeal the dissent of Associate Justice Looney becoming, on rehearing, the majority opinion of this Court. The cause was there “reversed and remanded to the trial court for further proceedings,” Judge Looney having set forth and discussed the various error on which reversal was based.
