The defendant in error (hereinafter designated as plaintiff) instituted her action against the Richmond, Fredericksburg and Potomac Railroad Company (here*381inafter designated as defendant) to recover damages for the death of her husband, Warren G. Ellis, which she alleged was caused by the negligence of the defendant.
