This cause is presented on appeal from the district court of Pushmataha county. It was instituted in that court on the 9th day of September, 1937, by Edward Walsh, as plaintiff, who sought to quiet title to a half section of land situated in Push-mataha county, Okla., and in doing so to destroy an alleged outstanding tax title asserted to be claimed under a resale tax deed executed in 1931, purporting to convey the land in question to Pushmataha county, Okla., and a subsequent county commissioners’ deed executed on August 7, 1933, conveying the title of the county, if any, to Herbert Dierks,…
