MEMORANDUM OPINION

HENLEY, Chief Judge.

This is a habeas corpus proceeding brought by Floyd E. Clark, an inmate of the Cummins Unit of the Arkansas Department of Correction. Petitioner seeks to vacate the judgment and sentence of the Circuit Court of St. Francis County, Arkansas, entered and imposed in February 1971 following petitioner’s conviction of the crime of first degree rape of the person of his eight year old stepdaughter. Ark.Stats., Ann., section 41-3401.
