Complainant filed this bill in the Chancery Court of Haywood County to foreclose a deed of trust. This instrument was executed on the 1st of October, 1891, by H. E. Jones and wife and J. W. Jones to Samuel M. Jarvis, trustee, conveying certain lands in Haywood County to secure a note for $5,650 and interest for a loan that day ■ made by the Jarvis-Conldin Mortgage Trust .Company. The note and mortgage were afterwards — to wit, on the 15th of October, 1892 — assigned to complainant, a London *247corporation.
