On information charging that Herbert Carr did drive an automobile on a public highway, in Custer county, while under the influence of intoxicating liquor, he was tried, found guilty, and, in accordance with the verdict of the jury, was sentenced to pay a fine of $100 and to imprisonment in the state penitentiary for a term of six months. From the judgment he appeals.
