Pro se petitioner Eusebio Gonzalez (“Gonzalez”), who is currently incarcerated at Woodbourne Correctional Facility in New York (“Woodbourne”), seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2254 against Raymond J. Cunningham, Superintendent of Woodbourne (“Respondent”). Gonzalez was convicted in New York State Supreme Court (the “Trial Court”) of Manslaughter in the First Degree, in violation of New York Penal Law § 125.20(1).
