DECISION AND ORDER
SCULLIN, District Judge:
This action was brought by plaintiff seeking declaratory and injunctive relief and monetary damages under Section 504 of the Rehabilitation Act of 1973 (“The Act”), Section 202 of the Americans with Disabilities Act of 1990 (“ADA”) and 42 U.S.C. § 1983 for unlawful discrimination in the provision of services, programs and/or activities by a public entity. It is presently before the Court on cross motions for summary judgment.
