VALLÉE, J.

Defendant, Paul Burns, was charged by information and convicted by a jury of the offense denounced by Penal Code, section 273d, in that "on or about the 7th day of October, 1947,” he did "wilfully, unlawfully and feloniously make an assault and inflict a corporal injury upon Joy Burns, who was then and there the wife of the said Paul Burns, and that the said assault did result in a traumatic injury to said Joy Burns, a human being.” The defendant made a motion for a new trial which was denied.
