Certiorari issued out of the Supreme Court and attested on the 28th day of March-, 1904, directed to William McAdoo, as police commissioner of the police department of the city of New York, requiring him to certify and return to the. office of the clerk of the county of New York all and singular the proceedings liad before the police commissioner in relation to the dismissal of the relator from the police department.

Ingraham, J.:
The relator was a member of the police department of the city of New York. On the 4th of November, 1903, he disappeared. On November twelfth written charges were made of neglect of *101duty, in that he had been absent from four p. m., roll call, November 4, 1903, to four p. m. November 9, 1903, five consecutive days, and was still absent. These charges were not served upon the relator, as he could not be found and his whereabouts could not be ascertained.
