Appeal by the plaintiff, William Jay Schieffelin, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 16th day of October, 1922, as resettled by an order entered in said clerk’s office on the 2d dáy of November, 1922, denying his motion for a temporary injunction, and also from an order entered in said clerk’s office on the 30th day of October, 1922, denying said motion upon reargument.

The action is brought by a taxpayer to restrain the defendants other than Dolan, city officiáls, from recognizing defendant Dolan as a member of the police force of the city of New York, upon the *352ground that, having been duly dismissed from said force on August 23, 1915, for extortion, his purported reinstatement therein on February 3, 1919, was illegal, void and of no effect. It appears from the papers on appeal that Dolan was duly appointed a member of the police force on October 25, 1913.
