MEMORANDUM AND ORDER

WOLF, District Judge.

The United States, the Commonwealth of Massachusetts and the State of New Hampshire (“plaintiffs”) brought these three consolidated actions under sections 107(a) and 113 of the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA” or “Superfund”), 42 U.S.C. §§ 9607(a) and 9613, and under the applicable laws of Massachusetts and New Hampshire.
