BYE, Circuit Judge.

Cynthia and Alan Roers appeal the district court’s grant of summary judgment in favor of Countrywide Home Loans, Countrywide Bank, 1 Bank of America, and LandSafe Appraisal Services (collectively “Countrywide”) on their claims of intentional and negligent misrepresentation, breach of fiduciary duty, and for rescission of contracts. We affirm the judgment of the district court with respect to the claims of misrepresentation and breach of fiduciary duty. On the Roerses’ claims for rescission, we reverse and remand for further proceedings consistent with this opinion.
