BROWN, Justice.

The briefs and the record before us disclose that this is a peculiar case in several respects.

We gather from the briefs and record that appellee, Sam Daube, became the purchaser of the lands in controversy in the year 1936 through a court sale made under judgment and order of the District Court of- Montague County in a suit brought by the State of Texas to recover judgment for delinquent taxes on the lands and a foreclosure of the tax lien.
