CLAUDE WILLIAMS, Justice.

Maurice Caranas sued Guy T. Jones, an individual, and G. J.’s, Inc., a corporation. The petition set forth two separate causes of action.

First, Caranas alleged that he was the owner of certain real property located on Field Circle between Hines Boulevard and State Highway 114 in the City of Dallas. He said that he entered into an agreement with Jones on April 9, 1962 wherein he agreed to construct a restaurant building on a portion of this property and upon completion thereof he would lease same, together with the improvements, to a corporation to be formed by Jones.…
