OPINION AND ORDER

DOMINGUEZ, District Judge.

Pending before the Court is Co-Defendant’s, Wilfredo Jirau Toledo, in his personal capacity, Motion for Judgment on the Pleadings Under Rule 12(c) of the Federal Rules of Civil Procedure. (Docket No. 36). Plaintiff opposed, thereafter filed a Motion supplementing their Opposition. (Docket Nos. 40 & 46).
