Nace Brower, by next friend (he being a minor), a citizen of the State of Mississippi, brought this action against James S. Watson, sheriff of Sunflower county, in said State, and the United States Fidelity & Guaranty Company, surety on said sheriff’s official bond, to recover damages which he laid at $25,000, basing his right to recover upon certain facts- alleged, in substance, as follows: (1) That Watson was elected to the office of sheriff in January, 1919, and as such it was his duty to, and he did, *628execute a bond with the…
