This cause, based upon an alleged breach of an agreement not to compete contained in an employment contract between Office Electronics, Inc. (OEI) and Thomas J. McSweeney, is before us for the second time. In the previous appeal we affirmed the order of the trial court which granted a preliminary injunction against McSweeney and the defendant Grafic Forms, Inc., particularly noting that no determination was made as to the merits of the case.
