This appeal is' prosecuted to reverse a decree of the circuit court of Peoria county entered in a partition suit which was instituted to divide 160 acres of farm land among certain persons, as heirs-at-law of Minnie Etta Murdock Appel. During the course of the proceeding a contest developed to determine whether such lands should be conveyed pursuant to an oral contract alleged to have been made, by Mrs. Appel in 1920, or should be partitioned according to the Statute of Descent. Minnie Etta Murdock Appel died April 27, 1942, leaving, as her only heirs, Henry Appel, her husband, Stella Jane…
