In this article 78 proceeding, the underlying substantive issue is whether the Board of Examiners of the Board of Education of the City of New York has warrant in law to refuse certification for appointment as a music teacher to a person who has what it calls “ defective vision ” or “ vision inadequate for the duties of the position ”, and who is “legally blind” but who otherwise apparently possesses all academic, professional and educational attainments required for the position.
