HALE, District Judge.

This case now comes before the court for final hearing upon bill, answer, replication, and proofs. The' bill prays that a certain portion of an issue of bonds issued by the defendant town may be declared a valid obligation of the town. On August 1, 1896, the town issued bonds to the amount of $8,500, bearing interest at the rate of 4 per cent, per annum. This issue of bonds was to aid in the construction of the Sebasticook Moosehcad Railroad from Hartland to Harmony; in this railroad the town was to take stock in return for the bonds so issued.
