Plaintiff in error, Lawrence J. O’Connell, was convicted in the criminal court of Cook county on a charge of embezzlement and sentenced to the penitentiary for a term of from one to fifteen years. The indictment consists of four counts. Each count contains an allegation as to the constituency of the Industrial Commission, its membership, and the appointment, qualification and service of plaintiff in error as clerk, agent and employee of said commission, in the capacity of chief security examiner.
