The defendant, Thomas J. O’Malley, Jr., was indicted in the circuit court of Stephenson County for the crime of embezzlement. The indictment contained eight counts, the first six charging defendant with the crime of embezzlement by an agent and the last two charging embezzlement by an attorney, a misdemeanor. In three of the first six counts, defendant was charged with embezzling unidentified property of the value of $1000 from Blanche Meinert on October 7, 1947, and in the other three counts the property was alleged to have been embezzled from Blanche Meinert, executrix of the will of Ralph…
