NEILL, Associate Justice.

This suit was brought by the appellee against appellant to recover damages for personal injuries alleged to have been inflicted by the negligence of the company on the 26th of April, 1906, at Lordsburg, New Mexico. In our view of the case it is unnecessary to state the grounds of negligence averred, or the specific injuries sustained.

The appellant answered by a plea of privilege, claiming the right to be sued in Harris County, Texas. Also by special demurrer, raising the question of jurisdiction, which being overruled, it filed a special plea to the jurisdiction of…
