FINDINGS OF FACT AND CONCLUSIONS OF LAW ON THE MOTION FOR SUMMARY JUDGMENT

This matter came before the Court on the Motion for Summary Judgment filed by Educational Credit Management Corporation (ECMC) and the Plaintiffs Response to ECMC’s Motion for Summary Judgment and Brief in Support of ECMC’s Motion for Summary Judgment filed by the Debtor, Darius L. Wynn. After considering ECMC’s motion and attached affidavit, the Debtor’s response and both parties’ briefs, the Court finds for the fol lowing reasons that the motion is well taken and should be granted.
