MEMORANDUM OPINION AND ORDER

JEFFREY COLE, United States Magistrate Judge.

The plaintiff, David Thorps, seeks review of the final decision of the Commissioner (“Commissioner”) of the Social Security Administration denying his applications for Disability Insurance Benefits (“DIB”) and Supplemental Security Income (“SSI”) under Title II of the Social Security Act (“Act”). 42 U.S.C. §§ 423(d)(2); 1314(a)(3)(A), 216(1) and 223(d)(2). Mr. Thorps asks the court to reverse and remand the Commissioner’s decision, while the Commissioner seeks an order affirming the decision.
