Ben J. Townsend was tried in the district court of Johnson county and convicted of manslaughter in the fourth degree. He has appealed, and contends the court erred in the admission of evidence, in permitting a too extended cross-examination of a witness, in refusing certain instructions requested, and in giving certain instructions.

Briefly, the charge was that on a date named, and while driving his automobile on a state highway, he unlawfully, feloniously, willfully, with culpable negligence, drove and operated the automobile in which he was…
