The exception raises but one point, and that is that the presiding Judge erred in granting the nonsuit, when the evidence showed facts that should have been submitted to the jury for their determination. It is conceded by both sides that the plaintiff brought his case under the Federal Employers’ Liability Act, as it was shown clearly by the evidence that the car was to be taken from one State to another State, and was engaged in interstate commerce at the time plaintiff was making repairs' on it.
