The complainants sued the defendant to recover $3,150 brokerage on a sale of his land allegedly made by them. The suit was based on a written contract dated March 14, 1944, expiring October 1, 1944, whereby defendant agreed to sell the farm (owned by him and his wife in the interests hereinafter set forth) for $21,000 net to him, giving complainants as their commissions all amounts in excess of that sum.
