The real estate involved in this action was originally the property of one Brown and wife, who on March 15, 1926, executed their promissory note in the principal sum of $2,000, payable to the order of Mary R. Nevitt, and to secure payment of the same they gave a deed of trust on the real estate. The property was purchased by the plaintiff, Martin D. Brennan, in 1928.
