POEEENBARGER, JüDGE:
This controversy relates to the oil and gas in a tract of two hundred acres of .land, situated in Monongalia County, formerly owned by Daniel Conaway, who died testate several years ago. By his will he devised said tract as follows: “To my daughter, Annina Ammons, to have and to. hoiu during the residue of the term of her natural life, but at her death to go to her heirs, I give and devise the residue of my home farm, being about two hundred acres, subject to an estate for life therein, which I *392hereby give and devise to my beloved wife, Malinda Oanaway.” The devisee,…
