BRAWLEY, District Judge.

The case is before us upon a writ of error to review7 a judgment of the United States District Court for the Western District of Virginia, whereby plaintiff in error was sentenced to serve two years in the penitentiary at Atlanta, Ga., and to *647pay a fine of $5,000, for the violation of section 5440 of the Revised Statutes (U. S. Comp. St. 1901, p. 3676). There are numerous assignments of error, but we have deemed it unnecessary to consider any except that presented in defendant’s bill of exceptions No. 15, wherein the facts relating to the return of the alleged…
